WHAT CAN YOU SPEND THE CERTIFICATE FUNDS ON?

According to current legislation, from 01/01/2016 relevant four target areas, within which you can spend money. Here they are:

Improving family living conditions- the most popular direction. It implies:

purchasing a new home through any legal transaction (with or without credit, through participation in a cooperative, etc.);

reconstruction of a private house.

Education and maintenance of any child in an educational or training institution.

Adaptation and social integration of disabled children.

This new direction formally began to operate on January 1, 2016, but for a long time the Government did not approve the necessary list of goods and services for which money can be allocated.

Mother's funded pension- the least popular direction.

The conditions for disposing of funds may change in the near future. In society and in initiative groups they are discussing new directions for using money:

fixed lump sum payment from mat. capital;

monthly payments to low-income families;

the opportunity to buy a domestically produced car or land;

the right to repair housing or supply communications at the expense of maternal capital.

So far the last four directions are - only in the project. Time will tell whether at least one of them will be approved.

WHAT WILL HAPPEN TO MAT CAPITAL AFTER 2018?

There are a few hypothetical scenarios situations after December 31, 2016:

The program will be extended again in the form it is now, for 2 years, 5 or 10 years. The situation with the birth rate in the Russian Federation cannot be called stable, and in the next few years a decrease in the number of women of childbearing age is expected. To maintain demographics, measures to encourage the birth of children will be simply necessary.

Mat. capital will be abolished. This is precisely the option provided for in Law No. 256-FZ. This may happen due to the fact that:

matkapital will fulfill its social objectives;

it will show its ineffectiveness (unlikely, because the country's leadership speaks of the extreme effectiveness of the program);

budgetary capacity will no longer allow spending funds to support families;

for other reasons;

without explanation, just according to the law.

From 2019 the program will be extended in a significantly modified form. For example:

change the direction of use of funds;

will continue to implement the initiative only in certain regions;

will reduce the circle of recipients by introducing the recently declared principles of targeting and need. The Ministry of Labor considers the option of materially stimulating the birth rate only among the poor to be a dead end and unjustified, and recommends against taking such steps.

Other proposals aimed at changing the conditions of the mat. capital may arise both before and after 12/31/2018.

From time to time, bills appear aimed at modifying the program. For example, the rejected bill No. 571638-6 proposed to issue maternity capital in the amount of 1.5 million rubles between 01/01/2017 and 12/31/2026, but only after birth third child.

At the same time, back in 2014, the Ministry of Economic Development advised terminate the program early due to the fact that it does not stimulate fertility, but only promotes the birth of a second child at an earlier date. This would allow saving 300 billion budget rubles annually.

CONCLUSION

There is hardly any need to fear that maternity capital will be abolished or substantially modified until December 31, 2018. After all, in addition to the social, the program also has a certain political connotation. The initiator of its introduction, and then extension for another 2 years, was the current president Vladimir Putin.

Since we are facing new presidential elections in 2018, there is a chance to hope for a subsequent extension of the program as part of an election promise or the good political will of the new head of state.

The program is socially very important and is a help to many families. However, for the poorest, using money poses challenges. On the other hand, the principle of social responsibility invites families who decide to have children to find means to support them on their own, abandoning dependent attitudes. Which of these opinions will prevail in the future, and whether the budget will cope with the social burden in the form of maternity capital, is still unknown.

Russian families with one child and planning children in the future are waiting with particular trepidation for information about the extension of the current one after 216. The latest news on this issue arrived literally at the very end of 2015: Federal Law No. 433-FZ of December 30, 2015 amended the legislation on maternity capital and carried out the order of the President of the Russian Federation regarding the extension of the state program until 2018 inclusive.

Since indexation was not carried out this year due to economic problems, obviously, the next increase in maternity capital should be expected only at the beginning of 2017. Experts suggest that next year the increase after indexation could be set at 6%.

Use of maternity capital funds in 2016

The latest innovation among the purposes of use is the ability to use maternal capital funds for social adaptation and rehabilitation of disabled children, including the purchase of necessary equipment.

The final decision on this issue will be made on February 18, 2016 after the Government of the Russian Federation approves the Anti-Crisis Plan for the current year.

What to expect after 2016?

The extension of the program for 2 years has already taken place, so many citizens are concerned about the issue of changes in the program that could be made to it this year. All proposed and discussed changes can be divided into the following groups:

  • regarding purposes of use;
  • regarding the requirements for families participating in the program;
  • relative to the size of the capital.

Expanding the purposes of use is the most pressing and debated issue. The areas in which maternity capital can be used, provided for by law, are not suitable for many; for example, some do not have the opportunity to purchase housing, including a mortgage. For this reason, in most cases, maternity capital remains unrealized. In this regard, legislators are considering expanding the opportunity to use maternity capital funds, for example, when purchasing a car, paying for treatment (expensive operations), opening a business, and others.

The President of Russia, when discussing the issue of extending the program, noted that its conditions might be revised. In particular, the circle of families eligible to participate in the program may be narrowed based on property, since the program was aimed primarily at supporting low-income families and families with difficult financial situations. In addition, the issue of providing state guarantee funds only to families with 3 or more children is being discussed.

Discussions regarding the size of maternity capital, unfortunately, come down only to the issue of indexation. Thus, depending on the state of the economy next year, it is planned to use an indexation coefficient equal to actual inflation. Taking into account the fact that in 2016 indexation was not used at all, the application of the declared indexation is also in question. The issue of increasing the amount of capital to 1.5 million rubles is also being discussed, but only for families with 3 or more children.

Attention! If the program providing 1,500,000 rubles for 3 children is approved, then, most likely, it will not apply to those families who have already used the right to maternity capital at the birth of 2 children.

Currently, all the proposals mentioned above are only at the discussion stage, and it is not yet possible to determine which of them will be approved and which will not. The adopted bill on prolongation of the program concerns the deadline itself. At the moment, it is premature to talk about any significant changes in the program itself in 2016.

Here are the two main conditions for obtaining maternal capital. Need to:

Not only the mother, but also the father can receive the certificate. To do this, it is necessary that he be the only parent and at the same time adopt a second, third child, etc.

Maternity capital is paid only once. That is, if you received it at the birth of your second child, you will no longer receive it at the birth of your third and subsequent ones.

The procedure for obtaining maternity capital

Obtaining a certificate for maternal capital is not very difficult. It is issued by the Russian Pension Fund. To receive capital, a parent applying for it must contact the territorial branch of the Pension Fund of the Russian Federation (or a multifunctional center) with a package of the following documents:

  • passport of the parent-citizen of the Russian Federation;
  • birth certificates of the first and second child (or a court decision on adoption);
  • parent's birth certificate;
  • an application filled out in the prescribed form;
  • Certificate of pension insurance of the parent and children.

Do not forget that you must be registered in the territory served by a specific Pension Fund branch. Copies (if necessary) of all documents are taken by a Pension Fund specialist, who also certifies them.

If the father receives maternity capital (and sometimes it happens that the children themselves), then you will need to provide the Pension Fund with a death certificate of the mother (or a court decision declaring the mother deceased). If the mother has been deprived of parental rights, then a corresponding court decision is provided.

Reviewing your application and checking the accuracy of all data will take no more than one month. As soon as it is reviewed, a specialist from the Pension Fund will contact you and inform you on what day you can receive the certificate. Or you will receive such a notification by mail.

On the appointed date, you come to the Pension Fund and they give you a certificate in your hand. In addition, today it is possible to issue a certificate in the form of an electronic document (the desired form of receiving the certificate is indicated in the application).

Where to spend money?

Maternity capital is allocated for the purposes provided for by law only after three years after the birth or adoption of a child. Unfortunately, there are no exceptions to this rule yet.

The law provides for strictly defined cases in which maternity capital is used. One such case is the improvement of living conditions. According to statistics, this is exactly what more than 80% of families spend their capital on. You can also spend money on children’s education, on accumulating a mother’s pension, and on the purchase of goods and services intended for the social adaptation and integration of disabled children into society.

Using capital to improve living conditions means you can use it to repay part of a mortgage loan, use it to buy an apartment, build a residential building with it, etc. If you want to spend money on your children’s education, you can pay for kindergarten, school, and university education from your maternity capital. The third option involves investing in a future pension through, for example, non-state pension funds.

It is allowed to use maternal capital in several directions at once.

The Pension Fund reminds that since 2018, the maternity capital program has been expanded taking into account new demographic measures adopted by the Government of the Russian Federation to support Russian families with children. It should be remembered that the monthly payment is set for one year and after this time the family must re-apply to the Pension Fund client service or multifunctional center to submit a new application for funds.

Maternity capital, changes. Preschool education, child care and supervision

Maternity capital has always provided for the disposal of funds for educational services for children. Previously, it was possible to use money for these purposes only three years after the birth or adoption of a child for whom maternity capital was issued.

Starting in 2018, families receive financial support for preschool education almost immediately after the birth of a child, since now maternity capital can be used within two months from the date of acquiring the right to it. You can use the funds during this period to pay for kindergartens and nurseries, including private ones, as well as to pay for child care and supervision services. In both cases, a necessary condition is that the organization has a license to provide the relevant services.

Maternal capital. Preferential mortgages for families with two and three children

Russian families in which in 2018-2021 If a second or third child appears, they will be able to take advantage of preferential loan terms to improve their living conditions. Preferential mortgages can also be repaid using maternity capital. It is not necessary to wait until the third birthday of the child who gives the right to a certificate.

Despite the fact that preferential lending conditions are not directly related to the maternity capital program, this is, nevertheless, an important step by the state to support families with children. Loan funds are allocated to families with two and three children at a preferential rate of 6% per annum. They can be used to purchase an apartment or house, including a plot of land, as well as housing under construction under an agreement of participation in shared construction. Previously issued loans and loans for the purchase of housing can also be repaid using preferential mortgage funds.

It is also worth recalling that the opportunity to join the maternity capital program has been extended until December 31, 2021. That is, to obtain the right to maternity capital, it is necessary that the child who gives the right to the certificate be born or adopted before December 31, 2021. At the same time, the receipt of the certificate and the disposal of its funds are not limited by time.

What can you spend maternity capital on in 2018? Law

The entire procedure for the emergence of the right, by whom and in what case the certificate is issued, as well as the rules for the implementation and use of funds are fixed at the federal level in Law No. 256-FZ of December 29, 2006.

The circle of persons who can qualify for the right to receive MSK:

  • a citizen of the Russian Federation who became a mother (or adoptive parent) after the birth of a second or any subsequent child in 2007;
  • the child’s natural father or his adoptive parent, if the mother has died, has been deprived of parental rights in relation to this child, and has also committed a crime against children. Here the man's nationality does not matter;
  • a citizen of the Russian Federation, if he turned out to be the only person - the adoptive parent of the second or next child by court decision. The entry of the decision must be after the date of 01/01/2007;
  • under certain legal circumstances, a child who has not reached the age of majority (or several children in equal shares) can receive a certificate for MSK.

The right to issue, receive and use a certificate for family capital under the Law arises only once and its funds can only be spent on certain types. Initially, Law 256 provided such an opportunity in only three areas:

  1. Increasing living space or improving living conditions.
  2. To cover the educational expenses of any child in the family.
  3. In the form of funds being transferred to the personal account of the child’s mother as an increase in her funded portion for a pension.

Since the beginning of 2016, a new direction of funds has appeared, thanks to which it has become possible to carry out the adaptation of disabled children.

It is also noted that there is no deadline for applying for a certificate. This means that an applicant who has the right to assistance from the state in the form of family capital can apply for a document either immediately after the birth of a baby in the family or much later. He does not lose the right over time.

Until 2015, the amount was indexed annually. At the same time, previously received certificates with a printed amount do not require replacement. When applying for disposal of funds, the amount indicated as of the date of filing the application for disposal will be applied.

The law establishes that you can exercise your right to use maternity capital funds after the child, in connection with whose birth it appeared, turns 3 years old. But there are exceptions that most families take advantage of. This is a very successful rule for many young families, which makes it possible not to wait until the age of three.

These are the following cases:

  1. Repayment of a bank loan taken to improve housing, as well as interest on it.
  2. Purchasing services and goods for adaptation of a disabled child to society.

The certificate amount in these areas can be used at any time by writing an application to the territorial body of the Pension Fund of the Russian Federation or submitting it through the MFC.

If it happens that the original document is lost, the owner of the certificate can receive a duplicate. It is valid only upon presentation of a passport.

Since capital funds are transferred only by non-cash means, fraudulent schemes constantly arise that create dishonest ones.

Important! Certificate holders should be aware that these are illegal methods of cashing out and they become accomplices in criminal acts.

There is only one legal option for cashing a document, when a government decree makes it possible to receive part of the funds in the form of a lump sum payment. This means that a family can receive a certain amount of money into their bank account, subject to personal application within the time frame specified by the resolution. Funds can be spent anywhere.

A number of regions, in addition to maternity capital funds, issue regional capital to families. Procedure for issuance and disposal in the amount of 100 thousand rubles similar to maternity capital, but it is provided to the family at the birth of the third child. The regional authorities, however, themselves determine where this amount is allowed to be spent; for example, in a number of areas it can be added to the purchase of a car.
