Increasing pensions for disabled children in 2019

As a rule, in families with a disabled child, there is an urgent need for money. This is due not only to expensive medicines, but also to the fact that the mother or father cannot fully work, since they must be near the child almost constantly. The amount of pension benefits intended for children with disabilities is reviewed annually.

The upcoming 2019 is no exception. It should be borne in mind that these payments are provided not from the Pension Fund, but from the federal budget. Money for the child is received by his mother / father, adoptive parent or guardian. All provided material resources must be spent exclusively for the needs of the disabled person. The amount of the allowance paid to a disabled child directly depends on the size of the minimum wage in force in a particular region of the Russian Federation. Under current legislation, the amount of pensions for disabled children is equal to sixty percent of the average minimum wage. Please note that this indicator is slightly different for each region. The amount by which the amount of benefits will increase depends on various circumstances related to the economic situation. What benefits and payments are due

Federal Law No. 178, which came into force on July 17, 1999, and deals with issues of state social assistance, states that every disabled child has the right to use a range of social services. This assistance is provided by the state. The set of social services includes some medicines, as well as medical products.

In addition, the state pays for the travel and stay in sanatoriums for a disabled child. The same expenses are provided for an individual traveling with a child (for example, for a father/mother/guardian). As for the duration of treatment of the sanatorium type, it is twenty-one days.   1. Social pension. There are several categories of state pension benefits. One of them is the social pension. In order for a child with disabilities to start transferring funds, one obligatory condition must be met. The disabled person must reside in the Russian Federation on a permanent basis.
  2. Monthly cash payments. Also, children with disabilities are entitled to receive special social benefits once a month. The amount of such a payment is about 2,400 rubles. Also, some additional opportunities have been introduced for parents of children with disabilities. For example, such a privilege as early retirement. A father or mother whose child suffers from physical disabilities can join the ranks of pensioners from the age of fifty. However, this requires certain conditions to be met. First of all, their child at the current time should not be more than eight years old. In addition, the minimum insurance experience of the parent must be fifteen years.

Also in article number 93 of the Labor Code, one more benefit is fixed for foster children of a disabled child. If a woman is caring for a disabled person, she has the right to work part-time. The child must be under the age of eighteen. With regard to wages, it is charged in direct proportion to the hours worked.

The legislation also establishes a number of prohibitions concerning this category of women. Article number 259, located in the Labor Code of the Russian Federation, states that the head does not have the right to send the mother or guardian of a disabled person on a business trip. This can be done only with the personal consent of the woman. It is not yet allowed to involve such employees in overtime work.

In addition, the employer cannot refuse employment to the mother of a disabled person, as well as reduce her wages. If a child who belongs to one of the disabled categories and is a minor is brought up without a father, then his mother has automatic protection against dismissal. An employment contract can only be terminated if the organization is liquidated or the woman has committed criminal acts.

A significant number of citizens (about 12 million people) receive a disability pension in the Russian Federation, including disabled children, who are one of the most vulnerable social groups (there are about 670 thousand people in 2020). For them, special measures of social support and additional types of assistance are provided, including material ones - a disability pension, a monthly income and a set of social services.

Of all the listed types of support, children with disabilities can count on only for social security, because they do not have insurance experience and did not deduct insurance premiums for a future pension. Therefore, they will be paid a fixed pension payment, set at the same rate for all children with disabilities.

Unlike disabled children, disabled people of groups 1, 2, 3 from childhood can apply for an insurance pension if they have at least one day of service. In this case, the payment will not be fixed, but will be calculated taking into account the accumulated pension points for the time of work.

Pension amount

The amount of social pension for disabled citizens, which include children with disabilities and disabled since childhood of groups 1, 2, 3, fixed for each category.     7. How do I apply for a food allowance?

    The monthly compensation payment to compensate for the increase in the cost of food for certain categories of citizens is paid for children:

    • single mothers (fathers);
    • military personnel undergoing military service on conscription;
    • from families in which one of the parents evades the payment of alimony;
    • from large families;
    • from student families;
    • who are disabled*.

    A parent, adoptive parent, stepfather or stepmother (for large families), a guardian or trustee of a child can issue a payment. Both the legal representative of the child and the child for whom the payment is made must live together and have permanent registration in Moscow. Citizenship doesn't matter.

    Paid for each child from the month of his birth until he reaches 3 years of age, provided that the application for the purpose of the payment was submitted no later than 6 months from the month in which the child was born.

      For a family in which one of the parents avoids paying child support

      one of the documents confirming non-payment of alimony by the second parent:

      • a message from the internal affairs bodies or a certificate from the bodies of the Federal Bailiff Service that the location of the wanted debtor was not established within a month;
      • notification of the authorized federal executive body on non-execution of a court decision (court order) on the recovery of alimony if the debtor lives in a foreign state with which the Russian Federation has concluded an agreement on legal assistance;
      • a certificate from the court on the reasons for non-execution of the court decision (court order) on the recovery of alimony.

      For a large family in which the children of the spouse (spouses) born in a previous marriage or born out of wedlock actually live

      Documents confirming that the child is being raised in the applicant's family:

      • marriage certificate (if the child was born out of wedlock)*;
      • death certificate of the second parent (if available) *;
      • divorce certificate*;
      • a court decision on the transfer of the child to the upbringing of the applicant, which has entered into force (a copy certified in the prescribed manner);
      • certificate of the child's education in an educational organization, issued no later than 30 calendar days before the day of applying for the provision of a public service (if the child is studying);
      • certificate of observation of the child in a medical organization, issued no later than 30 calendar days before the day of applying for the provision of a public service (if the child is observed in a medical organization).

      For a student family

      • certificate of parents' full-time education in a professional educational organization or an educational organization of higher education.

      For a family with a disabled child:

      • an extract from the certificate of examination in the federal state institution of medical and social expertise on the recognition of the child for whom the payment is made out as a disabled child.
